Termsand Conditions of Booking (the “Terms”)1.Service Provider

1.1.The courses/expeditions are provided by Feral yamyam Bushcraft  (hereinafter referred to as “Feral yamyam Bushcraft”,“we” or “us”)

1.2.Subject to clauses 7, 8 and 25, we will use our reasonable endeavours toprovide the courses/expeditions advertised on our website.

1.3.We will provide the courses/expeditions using reasonable care and skill.

1.4.We may appoint independent sub-contactors to run or assist on ourcourses/expeditions or use third parties to arrange or supply certain aspectsof our courses/expeditions. You agree that our obligation to you is to use reasonablecare in selecting competent, independent sub-contractors and third partysuppliers to provide reasonable services related to the course/expedition. Youagree that Feral yamyam  Bushcraft is notresponsible for the actions or omissions of such sub-contractors or third partysuppliers.

2.Booking and confirmation

2.1.If you are making a booking request for and on behalf of any other person, yourepresent that you are:

(a) the parent or legal guardian of suchperson if they are a minor; or
(b) a duly authorised agent of such person.

2.2.If you are purchasing a course/expedition as a gift, you agree that you willprovide the recipient with a copy of these Terms and notify them that byattending the course/expedition they will be deemed to have agreed to abide bythese Terms.

2.3.To submit a booking request, you must complete the booking form and pay theamount specified. You must ensure that all information provided in the bookingform is complete and accurate. If we accept your booking request, we wille-mail (or otherwise issue) a receipt of your booking to you and confirm thedate the balance, if any, is due. Any outstanding balance must be paid by thedue date specified in the receipt. If you haven’t received a booking receiptfrom us within 7 days of making your booking request, then please contact usat feralyamyam@outlook.com

2.4.By submitting a booking request, you agree to be bound by these Terms.

2.5. Abooking request constitutes an offer by you to purchase a course/expedition inaccordance with these Terms. Once your booking request is accepted by us (bythe issuance of a booking receipt), a separate legally binding contract willcome into existence (comprising these Terms, your booking request form and thebooking receipt) between us and each person named on the booking form (otherthan a minor, in which case the contract will be between you and us) (each, a“Contract”), provided, however, that you will remain liable for all paymentsdue. The date on the booking receipt is the date of such Contract.

2.6.These Terms, together with your booking request form and the booking receiptconstitute the entire agreement between us. You acknowledge that you have notrelied on any statement, promise or representation made or given by us or onour behalf which is not set out in such Contract.

2.7.You must check the details on the booking receipt when you receive it. If thereare any errors please contact us immediately at feralyamyam@outlook.com

2.8.We reserve the right, in our sole and absolute discretion and without the needto give reason, to refuse to accept a booking request. In such circumstances nocontract will arise and we will return any payment accompanying your bookingrequest.

2.9.Before a Contract comes into existence between you and us, we reserve the rightto increase or decrease the advertised price for a course/expedition and/or toamend any of the information contained in the course/ expedition description.

3.Payment

3.1.All course/expedition fees are payable in Pounds Sterling (“Sterling”). Theprices quoted are inclusive of VAT.

3.2.Unless otherwise specified in respect of a particular course/expedition, thefees payable with your booking request are as follows:

(a) for a UK course/expedition that isdue to commence:

(i) in 63 days or less from the date of your booking request, 100%of the course/expedition fee; or
(ii) more than 63 days from the date of your booking request, a deposit of 25%of the course/expedition fee; or

(b)for a non-UK course/expedition that is due to commence:

(i) in 90 days or less from the date of your booking request, 100%of the course/expedition fee; or
(ii) more than 90 days from the date of your booking request, 25% of thecourse/expedition fee.

3.3.The balance of the course/expedition fee, if any, must be paid by the datespecified in the booking receipt.

3.4.If you do not pay any balance in full by the due date, your booking will bedeemed cancelled and you will forfeit your deposit.

3.5.Payment will be accepted by:

(a) Maestro, Visa Electron, Visa debitand Solo debit cars or Visa/MasterCard credit cards, which can be used to makea booking on-line or by telephone; or
(b) bank transfer, which will need to be arranged directly with us over thetelephone (please see the contact page for contact details at http://dean4761.wixsite.com/feralyamyambushcraft or by e-mail at feralyamyam@outlook.com

4.Price changes

4.1.If our costs of running a course/expedition increase for reasons beyond ourreasonable control (including, without limitation, an increase in taxes, dutiesor fees by a government, other governmental action or an increase in the costof transport, labour or materials) we reserve the right to increase thecourse/expedition fee. Any such increase in the course/expedition fee will benotified to you as soon as reasonably practicable. If the course/expedition feeis increased by 10% or more, you will be entitled to cancel your booking andobtain a full refund of all monies paid to us. Otherwise, you will be requiredto pay such additional amount on the same terms as your original payment.

4.2.We pay our suppliers for the services associated with a non-UKcourse/expedition in a currency other than Sterling. Prices listed forcourses/expeditions on our website are based upon an exchange rate which iscalculated at the time of advertising the courses/expeditions. If requested, wewill be pleased to advise the exchange rates upon which we base thecourse/expedition fee at the time of booking. Exchange rates are continuallyfluctuating. We will endeavour to absorb the effect of any minor variation inthe value of local currency. However, if the value of the exchange rate variesconsiderably beyond the levels we have used, we reserve the right to levy asurcharge on the course/expedition price. You will be required to pay suchadditional amount on the same terms as your original payment. If we levy asurcharge in excess of 10%, you will be entitled to cancel your booking andobtain a refund of monies paid to us, provided that the cancellation is madewithin 7 days of us notifying you of the surcharge.

4.3.Our booking system is supplied by a third party supplier. Whilst we endeavourto ensure that the most up-to-date and correct prices are shown on our websiteand within the booking system, there is the possibility of an inconsistentprice between the two. Once we become aware of any such inconsistency, we willact promptly to rectify the inconsistency and we will endeavour to notify youas soon as reasonably possible. We reserve the right to cancel a booking madeat an incorrect price under such circumstances and you will be given the choiceof amending your booking to a course/expedition at the correct price orobtaining a full refund of monies paid to us.

4.4.We will not be liable to pay any compensation or incidental costs or expensesthat you may incur as a result of such cancellation or for any other loss ordamage howsoever caused arising out of such cancellation. We recommend that youtake out appropriate insurance, which includes cover against such cancellation.

5.Number of participants

5.1.Each course/expedition is subject to a minimum number of participants for itsoperation and is subject to cancellation at short notice if there is aninsufficient number of participants. If a course/expedition is cancelledbecause of an insufficient number of participants, you will have the option ofbooking an alternative course/expedition with us or receiving a full refund ofmonies paid to us. We will not be liable to pay any compensation or incidentalcosts or expenses that you may incur as a result of such cancellation or forany other loss or damage howsoever caused arising out of such cancellation. Werecommend that you take out appropriate insurance, which includes cover againstsuch cancellation.

5.2.The course/expedition description will specify whether the course/expedition issubject to a maximum number of participants. Once the maximum number ofparticipants has been reached, no more booking requests can be made.

6.Cancellation by you

6.1.Any cancellation must be notified in writing by the person who made the bookingto feralyamyam@outlook.com


6.2.if you cancel on the same day as the course/ event or expedition starts you forfeit 100% of the fee.


6.3.If you cancel your course/expedition, the following cancellation charges willarise:

(a) for a UK course/expedition cancelled:

(i) 63 days or less before the course/expedition is due tocommence, 100% of the course/expedition fee; or
(ii) more than 63 days before the course/expedition is due to commence, thefull amount of your deposit or 25% of the course/expedition fee (as applicable);and

(b)for a non-UK course/expedition:

(i) 90 days or less before the course/expedition is due tocommence, 100% of the course/expedition fee; or
(ii) more than 90 days before the course/expedition is due to commence, thefull amount of your deposit or 25% of the course/expedition fee (asapplicable).

6.4.Failure to attend on a course/expedition will be deemed a cancellation and youwill forfeit 100% of the course/expedition fee.

6.5.An updated statement of your account will be sent to you following any suchcancellation by you.

6.6.You acknowledge and agree that it is reasonable for such a cancellation chargeto arise given the requirement for us to make preparations and payments for acourse/expedition substantially in advance of the commencement of thecourse/expedition.

6.7.We appreciate that wholly unforeseen events may result in your cancellation ofa course/expedition booking. We therefore recommend that you take outappropriate insurance, which includes cover against such cancellation.

6.8.If you leave a course/expedition prior to its completion, you will forfeit allsums paid to us.

7.Cancellation by Us

7.1.We reserve the right, in our sole and absolute discretion, to cancel acourse/expedition or all or any bookings prior to the commencement of acourse/expedition for any reason whatsoever at short notice (including, withoutlimitation, if the minimum number of participants required for acourse/expedition is not fulfilled). In these unusual circumstances, all moniespaid to us will be repaid in full.

7.2. Acourse/expedition may also be cancelled either before or after its commencementfor reasons of Force Majeure (as defined in Term 24 below).

7.3.We will not be liable to pay any compensation or incidental costs or expensesthat you may incur as a result of such cancellation or for any other loss ordamage howsoever caused arising out of such cancellation. We recommend that youtake out appropriate insurance, which includes cover against such cancellation.

8.Changes by Us

8.1. Acourse/expedition description constitutes only an indication of what thecourse/expedition is planned to accomplish. The course/expedition descriptiondoes not form part of the Contract between you and us. Although we will use ourreasonable endeavours to provide a course/expedition as described, the natureof the courses/expeditions we offer necessitate a degree of flexibility and youaccept that any aspect of a course/expedition (including, without limitation,the content, location, route or order) may be affected by and/or altered due tocircumstances beyond our control or in the interests of the participants. Youaccept that delays and alterations and their results, such as inconvenience anddiscomfort, are possible. Such delays and alternations and their results are inthemselves great learning experiences and will help equip you for your futureendeavours in the outdoors.

8.2.Any additional expenses due to alterations shall be borne by each participant.

8.3.We will not be liable to pay any compensation or incidental costs or expensesthat you may incur as a result of any alterations to your course/expedition orfor any other loss or damage howsoever caused arising out of such alterations.We recommend that you take out appropriate insurance, which includes coveragainst such costs, expenses, losses or damage.

9.Insurance

9.1.You are required to obtain insurance against medical and personal accidentrisks. This must be for the activities undertaken, be valid for the country(and area) you are visiting and include medical expenses, repatriation costs,air ambulance and helicopter rescue services. We also recommend that you areinsured against cancellation, curtailment and the loss of, damage to or theftof your baggage and other personal belongings.

9.2.It is your sole responsibility to ensure that the insurance cover you purchaseis adequate and sufficient to meet your requirements and you will be requiredto confirm this at the time of booking. It is also your sole responsibility todisclose any material facts such as pre-existing medical conditions to yourinsurers.

10.Flights, Passports, Visas and Vaccinations

10.1.Where relevant, flights, passports, visas and vaccinations are entirely yourresponsibility and must be arranged prior to your course/expedition.

10.2.We take no responsibility for your cancellation of your course/expedition ifyou are not allowed to fly, enter a country or begin or continue yourcourse/expedition because of issues relating to passports, visas, vaccinationsor any other reason.

11.Health, Diet and Language

11.1.Generally, our courses/expeditions require you to be in good physical andmental health and, by attending the course/expedition, you confirm that you arephysically capable of participating in the course/expedition and that you arein good health with no medical history that would make it dangerous (for you orothers) for you to participate. Some courses/expeditions may have specificfitness requirements as more fully described in the relevant course/expeditiondescription on our website.

11.2.If you have a special medical requirement or health condition, you must informus prior to the commencement of your course/expedition.

11.3.If you have any special dietary requirements, you must inform us prior to thecommencement of your course/expedition.

11.4.For the health and safety of all participants, it is your responsibility tohave sufficient fluency in English to understand safety instructions which willbe given in English.

11.5.If in the sole opinion of the course/expedition leader:

(a) you are unable to keep up with orparticipate in the course/expedition or your health or fitness may compromiseyour safety or the safety of others on the course/expedition; or
(b) there is a problem of effectively communicating with you and this iscausing a danger to you and/or others on the course/expedition, you may, in theabsolute discretion of the course/expedition leader, be removed from thecourse/expedition (and, if necessary, this may be against your will). In suchcircumstances, you will not be entitled to a refund of monies and we will notbe liable to pay any compensation or incidental costs or expenses that you mayincur as a result of such removal or for any other loss or damage howsoevercaused arising out of your removal. You will, on demand, reimburse us for ourreasonable costs of effecting your removal.

11.6Insect populations vary according to location, weather and time of year. Inmany locations, insects are unavoidable and are a natural part of the outdoorsexperience. We recommend that you come prepared with appropriate protection.

12.Your Equipment

12.1.You are responsible for bringing the appropriate clothing, baggage andequipment to a course/expedition, guidance of which will be sent to you afteryour booking has been confirmed.

12.2.Any information provided by us on such matters as climate, clothing, baggageand special equipment is given in good faith but without responsibility on thepart of Feral yamyam  Bushcraft.

12.3.If, in the sole opinion of the course/expedition leader, your clothing and/orequipment is deemed unsafe, you may be required to rent or purchase suitableequipment (if available) to continue the course/expedition and you may not beable to participate in the course/expedition until such items have beenprocured. In such circumstances, you will not be entitled to a refund of moniesfor any part of a course/expedition missed and we will not be liable to pay anycompensation or incidental costs or expenses that you may incur as a result ofsuch disruption to your course/expedition or for any other loss or damagehowsoever caused.

12.4.You will, on demand, reimburse us for our reasonable costs or losses inmaintaining your safety as a result of unsafe clothing and/or equipment.

12.5.All luggage and personal equipment are, at all times, at your own risk. We willnot be responsible whatsoever for any loss or damage to your luggage and/orpersonal equipment.

13.Use of Equipment and Land

13.1.You must use all reasonable care in the use of:

(a) any of our property and equipment;
(b) property and equipment provided by our suppliers; and
(c) the land used during the course/expedition;

andyou must comply with all reasonable instructions from our course/expeditionleaders and their assistants in relation to its use.

13.2.We reserve the right to charge you for the cost of replacement or repair ofitems of property or equipment lost or damaged by you during acourse/expedition. If any property or land is damaged by you during a course/expedition,we also reserve the right to charge you for the cost of reinstating theproperty or land to the condition it was in before you damaged it.

14.Your conduct

14.1.Specific course/expedition rules will be explained to you at appropriate timesduring the conduct of a course/expedition. You must observe these rules and thereasonable instructions of our course/expedition leaders and their assistantsat all times.

14.2.You must conduct yourself in a reasonable manner at all times and maintain standardsof conduct which are consistent with the aims of the course/expedition.

14.3.Parents, guardians, teachers and those in comparable roles in respect of minorsmust maintain control of those minors at all times, to the satisfaction of ourinstructors and ensure that they observe all rules and the reasonableinstructions of our course/expedition leaders and their assistants and conductthemselves in a manner consistent with the aims of the course/expedition.

14.4.If, in the sole opinion of the course/expedition leader, your behaviour isdeemed unsafe or unacceptable for whatever reason, you will, in the absolutediscretion of our course/expedition leader be removed from thecourse/expedition (and, if necessary, this may be against your will). Circumstancesin which this may occur include, without limitation, your intoxication; use ofnon-prescription drugs; disorderly, abusive or dangerous behaviour; intentionaldamage to property and failure of control over minors. In such circumstances,you will not be entitled to a refund of monies and we will not be liable to payany compensation or incidental costs or expenses that you may incur as a resultof such removal or for any other loss or damage howsoever caused arising out ofyour removal.

14.5.You will, on demand, reimburse us for our reasonable costs of effecting yourremoval.

15.Subsequent instruction

15.1.Unless otherwise stated in the course/expedition description, participation onone of our courses/expeditions does not qualify you to subsequently conducttraining courses of a similar nature and we do not condone or certify you toinstruct anything for which you have received instruction from feral yamyam Bushcraft.

16.Risks

16.1.It is a fundamental term of booking that you acknowledge and accept the risksand hazards that may be involved in the courses/expeditions conducted by us,including serious injury or death, loss or damage to property, discomfort andinconvenience.

16.2.In particular, you acknowledge and accept that:

(a) natural areas and waters are subjectto natural forces which may result in obstacles and hazards which can be lifethreatening or cause injury;
(b) being in natural areas may result in encounters with wild animals, whichcan be life threatening or cause injury;
(c) weather may change rapidly and may be extreme, presenting obstacles andhazards which can be life threatening or cause injury;
(d) you may travel to remote areas where access to rescue, evacuation and/orsuitable medical supplies and support may not always be available; and
(e) some countries we visit have disease-causing viruses, bacteria or otherpathogens not present in your home country.

16.3.Save as otherwise required by law, participants take part incourses/expeditions at their own risk.

17.Non-UK courses/expeditions

17.1.For each non-UK course/expedition, we may appoint independent sub-contractorsto run or assist on your course/expedition or use third parties to arrangecertain aspects of your course/expedition (including, without limitation,arranging local transport including four-wheel drive vehicles, coaches, trains,buses, water craft, helicopters or aeroplanes, meals and accommodation). Youagree that our obligation to you is to use reasonable care in selectingcompetent, independent sub-contractors and third party suppliers to providereasonable services related to the course/expedition. You agree that Feralyamyam Bushcraft is not responsible for the actions or omissions of suchsub-contractors or third party suppliers.

17.2.You acknowledge that safety standards in other countries, particularly lesswell developed countries, may not be the same as in the UK.

17.3.You acknowledge that you are responsible to make yourself aware through Foreign& Commonwealth Office advice, State Department warnings and any othersources available to you in regard to the safety of the countries and areas inwhich you will be travelling and to make your own decisions accordingly.

17.4.It is your responsibility to be adequately insured for travel to the countryand areas in which you will be travelling.

18.Accommodation

18.1.Where accommodation is provided as part of a course/expedition, it is usuallyin shared (normally twin) rooms or tents unless stated otherwise. Where clientsbook individually, they will normally be required to share accommodation.Sometimes, single accommodation is available. Where a single room is requested,a supplement may be payable. When making a booking you accept that thisadditional supplement may apply and, where relevant, you will be advised andinvoiced for the relevant amount. For some courses/expeditions, no singleaccommodation is available.

18.2.Accommodation is provided by third party suppliers. In exceptional cases, it ispossible that we may be advised that the reserved accommodation is unavailable.If this occurs, we will endeavour to provide accommodation of at least the samestandard in the same area. If only accommodation of a lower standard isavailable we may be able to refund the difference of the advertised pricebetween the accommodation booked and that available.

18.3.In many hotels, especially in Africa, insects in the rooms (e.g. cockroaches,etc) are almost inevitable. It should by no means be taken as a sign ofdirtiness.

19.Water/Electricity Supplies

19.1.In some of the less well developed destinations we visit, the water andelectricity services struggle to keep up with increasing demands. Limitedrainfall can put further pressure on its provision. Consequently, occasionalpower cuts and/or water restrictions may be experienced.

20.Independent Travel Arrangements

20.1.We will not be responsible or liable for your actions or your safety for anyindependent travel you undertake before, during (if you choose or are forced toleave) or after the course/expedition.

21.Course/Expedition Date Changes

21.1.Should you wish to change the date of your course/expedition, you may do so ifyou give us:

(a) more than 63 days notice prior to thecourse/expedition start date for UK courses/expeditions; or
(b) more than 90 days notice prior to the course/expedition start date fornon-UK courses/expeditions,

providedthat there is space available on the course/expedition on the date you wish tochange to.

21.2.Any such change will be subject to an administration fee of £25.

22.If You Have A Complaint

22.1.If you have a complaint during your course/expedition, you must bring it to theattention of your course/expedition leader at the earliest appropriateopportunity in order that remedial action may, if appropriate, be taken. Youexpressly acknowledge that it is unreasonable to take no action during thecourse/expedition but to complain later. Any outstanding complaint not resolvedduring the course/expedition must be notified to us in writing within 30 daysof the scheduled end of the course/expedition. To the extent permitted by law,we will not be liable in respect of any claims/complaints raised later than 30days from the end of the relevant course/expedition.

23.Minimum Impact

23.1.We respect natural environments, endeavouring to have as little impact on themas possible. We will insist on strict environmental practices to ensure thecontinued quality of the natural environments in which we conduct ourcourses/expeditions. Procedures for sanitation, rubbish disposal and clean-upwill be explained by your course/expedition leader and/or their assistants atappropriate times during the conduct of a course/expedition. You must observethese practices at all times.

24.Exclusions and Limitations of Our Liability

24.1.Nothing in these Terms shall limit or exclude our liability for:

(a) death or personal injury caused byour negligence; or
(b) fraud or fraudulent misrepresentation; or
(c) any breach of the obligations implied by section 12 of the Sale of GoodsAct 1979 or section 2 of the Supply of Goods and Services Act 1982; or
(d) losses for which it is prohibited by section 7 of the Consumer ProtectionAct 1987 to limit liability; or
(e) any other matter for which it would be illegal or unlawful for us toexclude or attempt to exclude our liability.

24.2.Subject to clause 24.1:

(a) we shall not be liable to you,whether in contract, tort (including negligence), breach of statutory duty, orotherwise, for any loss of profit, or any indirect or consequential lossarising out of or in connection with the provision of, or failure to provide, acourse/expedition; and
(b) our total liability to you in respect of all other losses arising out of orin connection with the provision of, or failure to provide, a course/expedition,whether in contract, tort (including negligence), breach of statutory duty, orotherwise, shall not exceed the price paid by you for the course/expedition.

24.3.Except as set out in these Terms, all warranties, conditions and other terms impliedby statue or common law are, to the fullest extent permitted by law, excludedfrom these Terms.

24.4.This clause 24 shall survive termination of any Contract and the completion ofany course/expedition.

25.Force Majeure

25.1.For the purposes of these Terms, a Force Majeure Event includes any act, event,non-occurrence, omission or accident beyond our reasonable control andincludes, without limitation, the following:

(a) strikes, lock-outs, boycott or otherindustrial action (whether involving our workforce or any other party);
(b) civil commotion, riot, invasion, terrorist attack or threat of terroristattack, war (whether declared or not) or threat or preparation for war;
(c) act of God (including, without limitation, fire, tempest, storm, flood,earthquake, subsidence, epidemic, or other natural disaster);
(d) failure in the provision of any utility, including power, gas, water, orcommunication services;
(e) malicious damage or sabotage;
(f) compliance with any law or governmental order, rule, regulation, sanction,embargo or direction;
(g) breakdown, cancellation or failure of machinery or transportation(including, without limitation railways, shipping, aircraft, motor transport orother means of public or private transport); or
(h) default of suppliers or subcontractors.

25.2.We will not be liable to you as a result of any delay or failure to perform ourobligations under these Terms as a result of a Force Majeure Event.

25.3.If the Force Majeure Event prevents us from commencing or completing thecourse/expedition as planned we shall, without limiting our other rights orremedies, in the sole discretion of the course/expedition leader either (i)seek an alternative means of meeting the course/expedition objectives in thetime available, provided the course/expedition leader determines that it isreasonable and safe to do so (including, without limitation, achieving theobjectives of the course/expedition at a different location or by following adifferent itinerary or route); or (ii) cancel the course/expeditionimmediately.

26.Variation of Terms

26.1.These Terms may be varied at any time, without notice. You will be subject tothe Terms in force at the time that you make a booking request, unless anychange to the Terms is required by law or government or regulatory authority inwhich case, the revised Terms shall apply to any booking you have previouslymade.

26.2.Before you enter into a Contract with us, we reserve the right to amend any ofthe courses/expeditions, services and/or prices described on our website.

27.Data Protection Policy27.1. Information about you andmembers of your party, including your names, contact details and any specialneeds, disabilities or dietary requirements is collected by us when you requestinformation or make a booking request with us. You are responsible for ensuringthat other members of your party are aware of these Terms and our Privacy Policy and that they consent to youacting as agent on their behalf in your dealings with us. We may disclose thisinformation to our service providers (who may be located outside the UK/EEA)for the purpose of providing you with your course/expedition arrangements. Onlyinformation necessary for this purpose will be disclosed to them. We may useyour information for the purposes set out in our Privacy Policy. We may disclose the same tocompanies who act as data processors on our behalf. Some information, forexample relating to your health, may be “sensitive personal data” within themeaning of the Data Protection Act 1998 (as amended from time to time). We needthis information to cater for your needs, but it is collected on condition thatwe have your positive consent. If you do not agree to our use of yourinformation, we cannot accept your booking request. By making a booking withus, you agree to allow your insurers, their agents and medical staff to discloserelevant information to us in circumstances where we may need to act in theinterests of everyone attending the course/expedition. For example, if youcontract an infectious illness whilst on a course/expedition, we may need tomake special arrangements for you and ensure that you do not return with thegroup immediately. You have the right to ask us in writing for a data subjectaccess request form to obtain a copy of the information which we hold about youin accordance with our Privacy Policy. 28.1.If any particular term or condition shall be held void or unenforceable inwhole or part by any court or other competent authority, the remaining termsand conditions, and the remainder of the term or condition affected, shallremain in full force and effect.

29.Construction of Certain References

29.1.In these Terms, the following rules apply:

(a) a person includes a natural person,corporate or unincorporated body (whether or not having separate legalpersonality);
(b) a reference to a person includes its personal representatives, successorsor permitted assigns;
(c) a reference to a statute or statutory provision (i) is a reference to suchstatute or statutory provision as amended or re-enacted from time to time and(ii) includes any subordinate legislation made under that statue or statutoryprovision, as amended or re-enacted from time to time;
(d) any phrase introduced by the terms including, include, in particular or anysimilar expression, shall be construed as illustrative and shall not limit thesense of the words preceding those terms; and
(e) a reference to writing or written includes e-mails.

30.Governing Law and Jurisdiction

TheseTerms and each Contract and any dispute or claim arising out of or inconnection with them (including non-contractual disputes or claims) shall begoverned by and construed in accordance with the laws of England and Wales andeach party agrees to submit to the exclusive jurisdiction of the Englishcourts.
